LARKANA: As many as 113 assistant sub inspectors were appointed in Sindh Police through Sindh Public Service Commission in 2004 against existing regular vacancies of units/ranges/regions throughout Sindh, but they have been denied promotions to next ranks.
Few of them complained to media here on Tuesday that as per policy of IGP Office/CPO such appointment orders were issued by Deputy Inspector General of Police, T&T Sindh, Karachi. Thereafter, as per Police Rules, they were deputed to undergo probationer ASIs’ Course at Police Training Colleges Shahdadpur and Saeedabad.
After completion of training comprising physical training, drill, law and musketry from Police Training Colleges, they said, they reported in CPO in the office of Deputy Inspector General of Police, T&T Sindh Karachi, from where they were relieved to report to concerned regions/units where their salaries were fixed.
In the units/regions, they underwent preliminary courses of A, B, C & D as per Police Rules 19.25 (1) and 19.25 (2), they said.
It is pertinent to mention that as per Police Rules 12.8(3), 12.8 and 13.18, after completion of probationary period of 3 years, each and every ASI has to be confirmed and his/her name will be brought in List-E but it has been extensively violated and their seniority has not yet been maintained, neither in the office of DIGP T&T nor at requisite Ranges which bars their promotions to the next higher rank of Sub-Inspector, thus they have been denied the promotion to next grade/rank which sheer violation of Law of Equity. While ASIs appointed against Shaheed Quota and lady ASIs who were also appointed with them have been promoted but these promotion of these ASIs have been deferred.
During whole service, they added, which is comprising over 13 years they have served in the department with dedication at police stations, offices and many of them are performing all kinds of operational duties, patrolling etc. and they have even participated in encounters, raids and achieved targets.
There is total length of service 25 years in general of a government servant out which 13 years have already passed without awarding seniority to them as per existing policy, now it has been told to them that a cadre of I.T. has been separately established where they will be adjusted and converted into non-uniform personnel whereas they were appointed in uniform in the rank of ASI which is in contradiction of Supreme Court’s judgement passed in Civil Petitions NOs.493, 494, 505 TO 508, 529 TO 532, 533, 601, 906 and 911 TO 917 of 2015 which inter alia says that Sindh Reserve Police and all other branches of Police Force such as Rapid Respondent Force (RRF), Sindh Reserve Police (SRP), Prosecution Branch, Telecommunication Branch, Female Police, Special Branch (Crime Branch) are separate cadres other than the District Police/Regular Police, although all of them are one Police Force which is an attached department of the Home Department under the Sindh Government Rules of Business, 1986 and Inspector General of Police is head of attached department.
Since all branches of Police Force are assigned with different and separate functions they are different cadres, therefore, the Provincial Government shall frame recruitment rules and the terms and conditions of their service separately for each cadre, except for those cadres in respect of which separate rules are already there such as Women Police and Prosecution Branch etc.
After framing of rules pertaining to recruitment and other terms and conditions of service as required under section 2 of Police Act 1861, separate seniority list of each cadre and in each scale/rank shall be issued as required under rule 9 of the Sindh Civil Servants (Probation, Confirmation and Seniority) Rules, 1975 wherein it is provided that in each cadre in a department there shall be a separate seniority list of a group of civil servants doing similar duties and performing similar functions and for whose appointment same qualifications and experience have been laid down. (4) There is no provision in law for transfer of officers/officials from one cadre to another cadre, therefore, all the transfers made from Sindh Reserve Police to District Police in violation of law and in pursuance of various Standing Orders are hereby nullified and all such officers are directed to be repatriated to their parent branch i.e. Sindh Reserve Police.
It is important to note that since inception of I.T Branch, Sindh Police has not been able to keep operational any single project whether it is Police Record, Office Management Information System (PROMIS) or any other project but a post of Director I.T. has been filled by violating recruitment policy. When an officer of DIG Rank is already posted for Technical cadre then why DIG for IT and Director for IT? The affected ASIs have urged concerned Sindh Government authorities to award them seniority along-with their batch-mates (Shaheed Quota and Female ASIs) and promotions to the next higher rank of Sub-Inspector so that justice prevails, Law of Equity is implemented and they are treated at par with their colleagues.
